Respect the Constitution WHEREAS, we affirm that no changes to the U. S. Constitution are necessary to safeguard election integrity; rather, unethical practices that undermine the fairness of elections must be addressed and eliminated; Keywords: voter suppression, ballot harvesting, proof of eligibility, partisan manipulation

Candidate/Issue Misrepresentation WHEREAS, we recognize that misinformation, bias, and partisan tactics by campaigns, media outlets, and advocacy organizations can mislead voters and distort election outcomes; Keywords: candidates, lobbyists, activists, free and fair reporting, analysis, investigative journalism, fact checkers

Perception Manipulation WHEREAS, we acknowledge that both government agencies and media 2 can, intentionally or unintentionally, exert improper influence on public perception and electoral outcomes; Keywords: partisan activism, social change, favorable legislation, cancel culture, search algorithm steering, unequal curiosity, unequal due diligence, misinformation, disinformation, administration narrative, party line, partisan propaganda, taint, exalt, abuse of the power of a trusted institution

NOW THEREFORE, BE IT RESOLVED
That the Senate of the State of [state name], the House of Representatives concurring, petitions the following actions:

  3. We propose that activities of the Commission shall abide by the following:
    1. The Commission shall be constrained such that no change will be required of the United States Constitution to fulfill the scope of the Commission
    2. Activities of the Commission shall be constrained as outlined in Article I, Section 4, Clause 1 of the United States Constitution, to wit: "The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof…"
    3. All activities of the Commission shall be within the scope outlined in Article I, Section 4, Clause 1 of the United States Constitution, to wit: "…the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators."
  4. That the Commission shall accomplish the following goals:
    1. Overhaul Existing Election Law Conduct a thorough review of current election legislation and recommend the complete overhaul or replacement necessary to provide an efficient, transparent, secure, timely, guaranteed accurate result Free and Fair election process absent of any and all influences except the Will of the People, inclusive of the following at a minimum:
      1. Prohibition of monies or in-kind donations contributed to influence the outcome of an election, question or proposition be limited to contributors who reside in that jurisdiction
      2. Establishment of Journalism and Fact Checking Standards, the violation of which will have penalties sufficient to drive the violating organization and any of its successors out of business within 24 months of initiating violation.
      3. Establishment of Standards holding heads of Government agencies and CEOs of companies personally liable for partisan actions taken by their organizations or members of their organizations that could materially influence the outcome of an election.
      4. Prohibition of organizations that are recipients of monies or benefits resulting from the passing of legislation that benefit their organization shall not be permitted to make contributions to any existing or candidate legislator who voted for or influenced another to vote for that legislation.
      5. Granting unrestricted timely access to Federal, State and Local data sources and updates necessary to accomplish goal 4.h. Access shall be via electronic transfer in an automatable format.
    2. Establish Truth in Campaigning Establish a Division of Election Campaign Practices (Division or DECP) whose charter and authority over election communications 3 is as follows:
      1. Establish and enforce election “truth-in-advertising” regulations, policies and guidance
      2. Establish and enforce guidance for election decorum reflective of an attitude of "Worthy Opponent" as opposed to "Evil Adversary"
      3. Require that election campaigns submit proposed election communications for approval prior to their public dissemination
      4. Provide timely review of submitted proposed election communications, providing either approval, or clear description of violations that result in disapproval
      5. Require that election campaigns include a statement in their communication that it has been approved by the DECP
      6. Require that all financial or in-kind sponsorship and orchestrated messages (astroturfing) be fully disclosed in the communication
      7. Require election campaigns to tell the truth and to back up their claims with reliable, objective evidence
      8. Prohibit unfair or deceptive communication in any medium. That is, election communication must tell the truth and not mislead voters. A claim can be misleading if relevant information is left out or if the claim implies something that's not true.
      9. Advocate effective election campaign self-regulation
      10. Prepare consumer education materials
      11. Impose timely crippling penalties for violation of requirements and prohibitions
      12. Establish an ongoing effective public communication program to educate voters on Free and Fair Elections
    3. Achieve Nonobligatory Campaign Financing Devise a means of funding elections that does not tie contributions to post-election actions
    4. Eliminate Voter Suppression and Fraud Establish mandatory State standards for the following:
      1. Nominally equal availability of voting locations and capacities
      2. Maximum acceptable wait times and long lines
      3. Irrefutable record of each person who cast a ballot, linked to their Photo ID
      4. No-cost provision of required voter documentation including Photo ID and citizenship evidence such as certified birth certificate
    5. Eliminate Weaponized Agencies Establish a Federal Government-wide Code of Conduct training curriculum that establishes non-negotiable Standards of conduct, the violation of which will result in immediate termination and forfeit of severance and pension benefits.
    6. Reestablish Public Servants Recommend additions to criminal law that define unacceptable practices of influence peddling, pay-for-play, pay-for-access, insider information, and other activities that skirt current criminal laws
    7. Integrate Legal Immigrants into America Establish residency, and training curriculum requirements for naturalized citizens that must be tested and passed prior to the conferring of voting rights, consisting of the following as a minimum:
      1. The United States Constitution
      2. The branches of the Government and their purpose
      3. Patriotism
      4. United States way of life, culture and laws
      5. Requirement that naturalized persons commit to assimilation into United States culture and expectations rather than their former nationality culture and expectations
      6. The demonstration of fluency in the English language
      7. Physical residency in the United States for a minimum of ten contiguous years
    8. Universal Voter Registration Establish a nationwide Voter Registration database primarily based on Social Security Numbers (SSNs) of every person residing in or a citizen of the United States, also recording any facts disqualifying that person from voting such as death, felony conviction, mental incapacity, or citizenship.
    9. Engage Citizens in Election Fairplay Establish a nationwide confidential Free and Fair Elections Hotline for whistleblowers and reporting of observations or suspicions of violation of Free and Fair Election Standards of any kind. Staff to provide prompt, timely investigation resolution. Widely communicate resolution of these issues and of campaign communication violations that have been addressed (see section 4.b) to the public where appropriate, as a means to grow and maintain public trust in election integrity/Free and Fair Elections.
    10. Achieve world-class Election Trust Develop and execute a plan for modernization of the election process, under State control, that implements unparalleled security, privacy, accuracy, participation, validation, forensic audit, standards, interoperability, accessibility, ease of use, and efficiency of operation.
  5. We propose that the National Emergency shall be concluded upon the accomplishment of the goals in section 4.
